The Trademark Law of the People's Republic of China stipulates that commodity trademarks, service trademarks, collective trademarks and certified trademarks can be registered in China and the exclusive right to use trademarks can be obtained. Trademark marks can be visual signs, including text, graphics, letters, numbers, three-dimensional signs and color combinations, as well as combinations of the above elements. Sounds and smells can not be registered as trademarks in China.
 
Commodity trademark refers to the trademark used in the production, manufacture, processing, selection or distribution of goods.
 
Service trademark refers to the trademark used by service providers to distinguish their services from those provided by others.
 
A collective trademark is a sign registered in the name of a group, association or other organization for use by members of the organization in commercial activities to indicate the membership of users in the organization.
 
Certified trademarks refer to the marks used by units or individuals outside the organization to prove the origin, raw materials, manufacturing methods, quality or other specific qualities of a commodity or service under the control of an organization that has supervision over the commodity or service.
 
China Trademark Office adopts the International Classification of Goods and Services Registered by Trademarks, and currently uses the 8th edition, which has 45 categories. A trademark registers a category as an application. Before applying for trademark registration, the applicant must determine the categories of international classifications to be registered and the names of specific goods or services corresponding to each category.
 
Qualifications of applicants for trademark registration: natural persons, legal persons or other organizations
 
The validity period of a registered trademark is ten years, counting from the date of approval of registration.
